Terms and Conditions

1. Who We Are

These Terms and Conditions ("Terms") govern your use of the Akili-Africa Education platform, including Akili Study Buddy, Akili for Teachers, Akili Supervisor, and Akili Research Companion (together, the "Services"), provided by Akili-Africa Education ("Akili", "we", "us"), based in Komani, Eastern Cape, South Africa.

By registering for or paying for any Service, you agree to be bound by these Terms.

2. The Services

Akili provides AI-assisted tutoring, essay and assignment marking, and postgraduate research support, delivered via WhatsApp and web-based dashboards, at the pricing set out on our website at the time of registration.

3. Subscriptions and Payment

• Services are billed monthly in advance, in South African Rand (ZAR), via our payment processor, PayFast.
• Your subscription automatically renews each month on the same calendar date as your first payment, unless cancelled beforehand.
• We reserve the right to change our prices. We will give at least 30 days' notice of any price increase affecting an existing subscriber, by email and/or WhatsApp.
• You are responsible for ensuring your payment details remain valid. A failed payment may result in suspension of access until resolved.
• Certain Services pause automatically over the December-January school holiday period and resume automatically at the end of January; you will be notified before this occurs.

4. Cancellation

• You may cancel your subscription at any time via the relevant product's account page, or by contacting us at info@akili-africa-education.co.za.
• Cancellation takes effect at the end of your current paid billing period. You will retain access until that date and will not be charged again.
• We do not, as a general rule, offer refunds for the unused portion of a billing period. See Section 9 for your statutory rights, which this clause does not limit.

5. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose, or to harass, abuse, or harm another person;
• Attempt to circumvent any access, payment, or security control on the platform;
• Share your account login details with anyone outside your immediate family or the individual the account was created for;
• Upload content you do not have the right to upload, or that infringes another person's intellectual property or privacy.

We may suspend or terminate access for breach of these Terms.

6. Intellectual Property

All content, branding, software, and materials that make up the Services remain the property of Akili or its licensors. You may not copy, resell, or redistribute any part of the Services without our prior written consent.

7. AI-Generated Content and Educational Disclaimer

• The Services use artificial intelligence to generate explanations, feedback, and marking suggestions. While we take care to make this content accurate and curriculum-aligned, AI-generated content may occasionally contain errors.
• Akili is a study and marking support tool. It does not replace a qualified teacher, examiner, or academic supervisor, and final academic responsibility for submitted work rests with the student.
• We are not liable for academic outcomes (marks, grades, pass/fail results, examination results) arising from use of the Services.

8. Children's Personal Information

• Akili Study Buddy is intended for use by school-age children under the supervision of, and with the consent of, a parent or legal guardian, who is the person who registers for and pays for the Service.
• By registering a child for the Service, you confirm that you are that child's parent or legal guardian, or have their consent to act on the child's behalf, and you consent to the processing of your child's personal information.
• We collect only the personal information reasonably necessary to provide the Service to your child (e.g. name, grade, and their questions and interactions with the tutoring system).

9. Consumer Rights

Nothing in these Terms limits any right you have under the Consumer Protection Act, 2008, that cannot lawfully be excluded or limited.

10. Limitation of Liability

To the maximum extent permitted by law, Akili's total liability to you arising out of your use of the Services is limited to the amount you paid us in the (three) months preceding the claim. We are not liable for indirect, incidental, or consequential loss.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email and/or WhatsApp at least 14 days before they take effect. Continued use of the Services after that date constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa, and any dispute will be subject to the jurisdiction of the South African courts.
